PureSwim Swimming School Regulations

1. General Provisions

  1. The following regulations define the terms and conditions for the provision of swimming instruction services by Akademia Pure Swim SzkoÅ‚a PÅ‚ywania Maciej Jura, operating under the abbreviated name Pure Swim SzkoÅ‚a PÅ‚ywania, with its registered office in Józefów at 34 PodstoÅ‚eczna Street, 05-410 Józefów; NIP (Tax ID): 5322094328, REGON: 389633040, hereinafter referred to as the Organizer.

  2. The Organizer possesses all the necessary agreements and documents required to conduct swimming lessons at the sports facilities where such classes are held.

  3. Individuals booking and participating in lessons, as well as their guardians, shall hereinafter be referred to as Participants.

2. Participation in Lessons

  1. A prerequisite for participation in any lessons conducted by the Organizer is good health and the absence of any contraindications for swimming as a physical activity.

  2. Acceptance of these regulations and reservation of a place in a class constitutes the conclusion of an agreement and an obligation to pay the fee, unless otherwise agreed with the Organizer.

  3. By accepting these regulations, Participants confirm that they have read and understood their content and agree to comply with their provisions.

3. Organization of Lessons and Enrollment

  1. Lessons are conducted by qualified instructors holding appropriate certifications.

  2. In the event of an instructor’s absence, the Organizer shall ensure a substitute qualified instructor with the necessary credentials. No additional cancellations or withdrawals from classes are permitted due to a substitute instructor.

  3. If it is not possible to provide a substitute, the payment for the missed class will be transferred to the next billing period.

  4. Enrollment for lessons takes place electronically via the registration form on the Organizer’s website through the ActiveNow platform, by phone, email, or via the Facebook Messenger communication tool.

  5. Each Participant, after registering for classes, will receive an invitation to create an account on the ActiveNow platform.

  6. Registration on the platform is mandatory to participate in lessons.

  7. To confirm enrollment, the Participant must pay an initial fee equivalent to the price of one booked class by bank transfer to the Organizer’s account. Payment must be made no later than 48 hours after reservation confirmation. This payment will be credited toward the total class fee.

  8. If the initial payment was made in advance and the Participant cancels less than 48 hours before the scheduled start of the lesson, the Organizer will refund 50% of the payment. The remaining amount covers pool space reservation and instructor time.

4. Individual and Pair Lessons

  1. Participants may choose lesson durations of 30, 45, or 60 minutes, or longer upon individual arrangement.

  2. Lesson times are determined jointly between the parties.

  3. Participants may register for single lessons or reserve a fixed recurring time slot.

  4. Lessons with fixed reservations take place during the school year as defined by the Polish Ministry of Education (MEN).

  5. At Szuwarek and SMS Pruszków pools, the pool entrance ticket is not included in the lesson price. Participants must purchase it separately at the facility’s ticket office.

  6. A Participant may add one additional person to an individual lesson (maximum of two persons per lesson).

  7. Adding a second person to the lesson results in a price adjustment according to the current price list and lesson duration.

  8. Participants must arrive on time for the lesson, already changed into swimwear, with a swim cap and goggles on.

  9. Any delay caused by the Participant will result in a proportional reduction of lesson duration.

5. Mini Groups (3 Participants) and Group Lessons

  1. Group lessons last 30 or 45 minutes.

  2. The pool entry fee is included in the price of group lessons, except for SMS Pruszków, where Participants must pay the entry fee separately at the facility’s ticket office.

  3. The Organizer ensures a maximum ratio of 6 Participants per instructor.

  4. The Organizer reserves the right to add one extra Participant to a class for the purpose of making up missed lessons.

  5. Participants must arrive on time, already changed into swimwear, with a swim cap and goggles on.

  6. Any delay caused by the Participant will result in a proportional reduction of lesson duration.

6. Absences, Cancellations, and Make-up Lessons

  1. The cancellation policy is the same for individual and group lessons.

  2. Participants may cancel up to two classes per month for each weekly reservation.

  3. To be valid, a cancellation must be made no later than 6 hours before the scheduled start time, except for lessons between 6:00–10:00 a.m., which must be canceled by 7:00 p.m. on the previous day.

  4. Cancellations can only be made via the Participant Panel on the ActiveNow platform.

  5. Properly canceled lessons may be rescheduled within 45 days of the cancellation date but no later than the last day of the school year as set by the Ministry of Education.

  6. Make-up lessons do not take place during holidays or breaks when regular classes are not held.

  7. Registration for make-up lessons can be made via the Participant Panel on ActiveNow or by calling the phone number listed on the Organizer’s website.

  8. Any additional absences within the same month will be counted as completed lessons with no make-up option.

  9. Make-up lessons may be taken at any pool where the Organizer conducts lessons. Lesson prices remain unchanged; however, pool entry ticket prices may vary.

  10. Group lessons may be made up through individual lessons, in which case the Participant must pay for the pool entry ticket according to the facility’s price list.

  11. Individual lessons may be made up in group classes; however, this does not reduce the lesson price. In such cases, the Participant does not pay the pool entry fee.

  12. In cases where the Participant cannot use purchased lessons due to serious health issues, the Organizer reserves the right to individually assess the situation and transfer the payment to another billing period upon prior arrangement between the parties.

7. Payments

  1. The billing period for all lessons is one calendar month.

  2. Single lessons or those without fixed reservations are paid per session, prior to each class.

  3. If no cancellation is made, fixed reservations automatically renew for the next month.

  4. The price list published on the Organizer’s website (www.pureswim.pl) constitutes an integral part of these regulations.

  5. For fixed reservations of individual or group lessons, the full monthly payment must be made (for the entire billing period). The fee also serves as a reservation of pool space and instructor time.

  6. Payments must be made by the 10th day of the month in which the lessons take place.

  7. Payments can be made via the ActiveNow platform (Tpay), by bank transfer to the Organizer’s account listed on the website, or in cash.

  8. Requests for a VAT invoice must be made before payment.

  9. If payment is overdue by more than 10 days, the Organizer may suspend services until payment is received. If no payment is made by the last day of the month, the Participant will be removed from the lesson list.

  10. Single or non-recurring lessons must be paid for before they begin, either through ActiveNow or directly to the instructor in cash.

  11. If a Participant joins during a billing period, they pay only for the remaining lessons that month.

  12. Participants may prepay for 12 lessons in advance and receive a 5% discount on the total amount. In case of withdrawal during the package period, the Organizer refunds 50% of the paid amount; the remainder covers pool and instructor reservation costs. The funds may also be credited toward other courses or future reservations.

8. Gift Vouchers

  1. The Organizer sells Gift Vouchers for a specified number and duration of lessons as agreed upon with the purchaser.

  2. Each voucher is valid for six months from the date the payment is recorded.

  3. Lessons purchased with a Gift Voucher are scheduled as single lessons, booked according to the Organizer’s availability.

  4. Lesson cancellations follow the same rules as described in Section 6 of these regulations.

9. Conditions for Electronic Service Provision

  1. To properly use the Organizer’s website and related electronic services, the following technical requirements must be met:

    • Internet access;

    • A web browser enabling the use of the reservation panel;

    • An active email account.

  2. The Organizer does not guarantee uninterrupted or error-free website access. Access may be limited due to maintenance, repairs, or updates.

  3. Participants are prohibited from providing unlawful content, including but not limited to:

    • Violations of third-party reputations;

    • Disclosure of third-party trade secrets;

    • Infringement of third-party intellectual property rights;

    • Acts of unfair competition;

    • Encouragement of illegal activities.

10. Terms of Concluding and Terminating Electronic Service Agreements

  1. Upon reviewing and accepting these Regulations, a civil-law agreement is concluded between Akademia Pure Swim SzkoÅ‚a PÅ‚ywania Maciej Jura, operating under the abbreviated name Pure Swim SzkoÅ‚a PÅ‚ywania, with its registered office in Józefów, and the Participant, governing the mutual obligations of both Parties. Matters not covered by these Regulations are governed by the provisions of the Polish Civil Code.

  2. Termination of a fixed lesson reservation must be submitted by email.

  3. Course resignations must be submitted no later than the last day of the month (for monthly billing) or by the date of the final lesson in the case of a 12-lesson package. Late submissions result in automatic extension of the reservation and payment obligation for the next period.

  4. In case of resignation during a billing period, no refund will be issued for unused lessons.

  5. If the Organizer cancels lessons, the Participant is entitled to a full refund for unused lessons.

11. Complaints

  1. Participants have the right to file complaints in accordance with the provisions of the Polish Civil Code.

  2. Complaints must be submitted electronically via email to: biuro@pureswim.pl.

  3. The Organizer will review the complaint and inform the Participant of the resolution within 14 days of receipt. The response will be provided via email.

12. Liability

  1. The Organizer is not liable for false information provided by the Participant, particularly concerning health conditions and eligibility for swimming activities, and bears no responsibility for the consequences of incorrect information.

  2. The Organizer is responsible for the Participant’s safety only during the class on the pool deck. Before and after lessons, including in the locker rooms, responsibility rests with the Participant’s legal guardian.

  3. The Organizer undertakes to treat clients with respect and conduct lessons to the best of their professional knowledge.

  4. The Organizer reserves the right to immediately terminate cooperation with individuals who fail to observe basic cultural norms, create dangerous situations, or disrespect staff or sports facilities. In such cases, no refund will be issued for unused lessons.

13. Image Use

  1. Acceptance of these Regulations constitutes consent for the Organizer to use and distribute the Participant’s image in photographs and videos for marketing purposes on the website www.pureswim.pl and on Facebook and Instagram.

  2. The Participant and/or Guardian has the right to withhold consent for image use by submitting a written statement via email to the Organizer.

14. Additional Information

  1. Notifications about canceled lessons due to technical issues, public holidays, or other circumstances will be posted on the Facebook page @pureswimwarszawa and/or communicated by phone.

  3. Any matters not covered by these Regulations are governed by the provisions of the Polish Civil Code.

  4. All disputes shall be settled by the court having jurisdiction over the Organizer’s registered office.

15. Privacy Policy

The Participant agrees to the collection and processing of their personal data solely for the Organizer’s use in providing electronic services, in accordance with Article 6(1)(a) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation – GDPR). The Participant also consents to receiving commercial information electronically from Akademia Pure Swim SzkoÅ‚a PÅ‚ywania Maciej Jura, operating under the abbreviated name Pure Swim SzkoÅ‚a PÅ‚ywania, with its registered office at 34 PodstoÅ‚eczna Street, 05-410 Józefów, Poland; NIP: 5322094328, REGON: 389633040; tel: +48 539 969 338; email: biuro@pureswim.pl, in accordance with the Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended).
