

PureSwim Swimming School Regulations
Effective as of September 1, 2025
1. General Provisions
-
These regulations define the terms and conditions for swimming instruction services provided by Pure Swim Swimming School, operated by Pure Swim Swimming School Maciej Jura, hereinafter referred to as the “Organizer,” located at 34 Podstołeczna St., 05-410 Józefów, Poland; Tax ID: 5322094328, REGON: 389633040.

The Organizer holds all required agreements and documentation necessary to conduct swimming lessons at the sports facilities where classes are held.

Individuals booking and participating in the classes, including their guardians, are hereinafter referred to as “Participants.”
2. Participation in Classes

To take part in any classes conducted by the Organizer, Participants must be in good health and have no medical contraindications to engage in the sport of swimming.

Enrollment in classes requires payment according to the current price list for either the full billing period or individual sessions.

By making a payment and/or attending a class, Participants accept these Terms and Conditions.

By accepting these Terms, Participants declare they have read, understood, and agree to abide by all provisions herein.
3. Class Organization and Enrollment
-
Classes are conducted by certified instructors with appropriate qualifications.
-
In the event of the assigned instructor’s absence, the Organizer will provide a substitute instructor with the required qualifications. No cancellations or refunds will be granted due to such substitutions.

If no substitute is available, payment for the missed class will be carried over to the next billing period.

Enrollment is carried out electronically through the ActiveNow registration form on the Organizer’s website, via phone, email, or Facebook Messenger.

After enrolling, each Participant will receive an invitation to register on the ActiveNow platform.
-
Registration on the platform is mandatory for participation.
-
To confirm registration, Participants must make an initial payment equal to the cost of one session via bank transfer within 48 hours of reservation confirmation. This payment is credited toward the total cost of the classes.

In the event of early payment of the initial fee and cancellation of classes less than 48 hours before their start, the Organiser shall refund 50% of the fee, with the remaining funds constituting payment for the reservation of space at the swimming pool and the instructors' working time.
4. Private and Semi-Private Classes

Participants can choose class durations of 30, 45, or 60 minutes, or longer as agreed individually.

Class times are scheduled in agreement with the Organizer.

Participants may book single sessions or reserve a recurring time slot.

Recurring sessions follow the academic school year as defined by the Polish Ministry of Education (MEN).

At the Szuwarek and SMS Pruszków swimming pools, admission to the pool is not included in the price of the classes. Participants must purchase tickets separately at the facility's ticket office.

Participants may add one additional person to a private session. Price will be adjusted accordingly based on session length and the current price list.

Participants are required to arrive on time, dressed in swimwear, wearing a swim cap and goggles.
-
Any delay caused by the Participant will result in a proportionate reduction in class time.
5. Small Groups and Group Classes
-
Group classes last 30 or 45 minutes.
-
The admission ticket to the swimming pool is included in the price of group classes. This does not apply to the SMS Pruszków swimming pool, where participants must pay for their admission ticket separately at the facility's ticket office..

A maximum of 6 participants is allowed per instructor. The Organizer reserves the right to add one more participant for makeup sessions.

Participants must arrive on time, in swimwear, wearing a swim cap and goggles.
-
Late arrival due to the Participant's fault will reduce class time accordingly.
6. Absences, Cancellations, and Make-Up Classes
-
Cancellation rules apply equally to private and group sessions.
-
Participants may cancel up to two classes per month for each weekly reserved time slot.
-
Cancellations must be made at least 6 hours before class start time, except for morning sessions (6:00–10:00 AM), which must be canceled by 7:00 PM the day before.

Cancellations must be made exclusively through the ActiveNow Client Panel.
-
Properly canceled sessions can be rescheduled within 45 days, but no later than the last day of the school year (as set by MEN).
-
Make-up sessions are not held during holidays or breaks when regular classes do not take place.
-
Make-up sessions can be scheduled via the ActiveNow platform or by phone using the contact number on the website.
-
Additional absences beyond the allowed two per month are forfeited without the right to a make-up session.

Make-up classes can take place at any facility used by the Organizer. Class prices remain unchanged; however, pool admission fees may vary.

Group class make-ups may be done in a private session setting, but Participants must cover the pool admission cost separately.
-
Private class make-ups may be done in a group setting, but no refund is given for the price difference. In such cases, the Participant does not pay for pool admission.
-
In the case of long-term illness or serious medical issues, the Organizer reserves the right to assess the situation individually and may transfer the Participant’s payment to a future billing period after mutual agreement.
7. Payments
-
The billing period for all classes is one calendar month.
-
Single classes and non-recurring sessions must be paid for in advance.
-
If the Participant does not cancel a recurring time slot, the reservation is automatically renewed for the next month.
-
The price list on the Organizer’s website (www.pureswim.pl) is an integral part of these Terms.
-
For reserved recurring classes, Participants must pay for all sessions in that month. The fee also serves as a reservation of the time slot and instructor’s availability.
-
Payments must be made by the 10th of the month in which the classes occur.
-
Payments can be made via the ActiveNow platform (Tpay), bank transfer, or in cash.
-
Requests for a VAT invoice must be submitted before payment.
-
If payment is more than 10 days late, the Organizer may suspend services until payment is received. If payment is not received by the last day of the month, the Participant will be removed from the schedule.

Single and non-recurring sessions must be paid before the class starts via ActiveNow or in cash directly to the instructor.
-
Participants enrolling mid-month will only be charged for the remaining sessions in that billing period.
-
Participants can pay for 12 classes in advance, in which case they are entitled to a 5% discount on the total amount. In the event of cancellation during the package period, the Organiser will refund 50% of the fee, with the remaining funds constituting payment for the reservation of space at the swimming pool and the instructors' working time. The funds may also be used for other courses and reservations in the future. Cancellations must be made at least one week in advance.
8. Gift Vouchers

The Organizer sells Gift Vouchers for a specific number and length of classes as agreed with the purchaser.

Each voucher is valid for 6 months from the date payment is received.

Classes booked using a voucher are scheduled like single sessions and subject to availability.

Voucher-based class cancellations follow the rules outlined in section 6.
9. Terms of Electronic Services
1.To access the Organizer’s website and services, the following technical requirements must be met:

Internet access

A web browser compatible with the registration system
-
An active email address
2.The Organizer does not guarantee uninterrupted or error-free website access. Access may be restricted for maintenance or upgrades.
3.Participants are prohibited from submitting unlawful content, including:

Defamation of third parties
-
Disclosure of trade secrets
-
Violation of intellectual property rights
-
Acts of unfair competition
-
Encouraging illegal activity
10. Terms of Agreement

After accepting these Terms, a civil agreement is formed between the Participant and Pure Swim Swimming School Maciej Jura, operating as Pure Swim Swimming School, located at 34 Podstołeczna St., 05-410 Józefów, Poland.

For any matters not covered by these Terms, the Polish Civil Code shall apply.

Cancellations of recurring reservations must be sent by email.
-
If canceled at least 48 hours before the first session of the new billing period, no additional costs will apply.

If canceled mid-period, no refunds are issued for unused classes.
-
If the Organizer cancels the sessions, the Participant will receive a full refund for the unused sessions.
11. Complaints

Participants may file complaints in accordance with applicable civil law.

Complaints must be submitted via email to: biuro@pureswim.pl.

The Organizer will review and respond within 14 days via email.
12. Liability
-
The Organizer is not liable for inaccurate personal or health information provided by the Participant, nor for any resulting consequences.

The Organizer is responsible for the Participant’s safety only during class time in the pool area. Before and after class, including in the locker room, responsibility lies with the Participant’s guardian.

The Organizer commits to respectful treatment and delivering lessons to the best of their knowledge and ability.
-
The Organizer reserves the right to immediately terminate cooperation with individuals who act disrespectfully, pose a safety risk, or fail to follow basic rules of conduct. No refunds will be issued in such cases.
13. Use of Image
-
By accepting these Terms, the Participant (and/or their guardian) grants the Organizer permission to use and distribute photos and videos for marketing purposes on www.pureswim.pl, Facebook, and Instagram.

Participants may withdraw consent by sending a written notice via email to the Organizer.
14. Additional Information
-
Information about canceled classes due to maintenance, holidays, or other reasons will be communicated via the @pureswimwarszawa Facebook page and/or by phone.

For matters not covered by these Terms, the Civil Code will apply.

Any disputes will be resolved by the court with jurisdiction over the Organizer’s location.
15. Privacy Policy
Participants consent to the collection and processing of their personal data solely for the purposes of providing electronic services, in accordance with Article 6(1)(a) of Regulation (EU) 2016/679 (GDPR), and to receiving commercial information from Pure Swim Swimming School Maciej Jura, operating as Pure Swim Swimming School.
